Car accidents occur almost hourly in Jackson, Mississippi and in Hinds County, which is at the top of the National Highway Traffic Safety Administration’s 2017 report on County Fatalities in the State of Mississippi.  Just last week two people died in a two car crash on Midway Road.  The accident is currently under investigation to determine the cause.

Data collected on counties experiencing the highest fatality rates in Mississippi Counties reveals Hinds County, Jackson to be at the top for five consecutive years.  Every year, residents in Mississippi lose over Eight Million Dollars because of car accidents and related fatalities.  Surviving car accident victims may lose work leading to financial strain, incur medical bills and costs resulting from long term rehabilitation and other unforeseen events, and live with the pain and suffering experienced as a result of a permanent unwelcome life change.

Mississippi is a Comparative Fault Law State and as such, enables plaintiffs to seek damages even if they played some part in the accident and are partially to blame.  It is a tort law that allows plaintiffs to sue for the percentage of damages caused by the defendant. Legal action can be brought against another party to an accident if the elements of negligence are present including: defendant owed the duty of care; had a breach in the duty of care; and the breach caused the injuries or loss to the plaintiff.

If you have suffered injuries and damages as a result of a car accident you should contact legal counsel to help you navigate your way around the ordeal.

The two types of damages that victims can sue for include:

1) compensatory damages which are those damages causing economic (loss of wages, medical bills, and property damage) and non-economic loss to victim (pain and suffering); and

2) punitive damages meant to punish the persons being sued (Defendants).
