Indiana state trooper hit by speeding vehicle at accident scene near Hammond.

Indiana – February 1, 2023

An Indiana state trooper was struck by a speeding vehicle at the scene of an incident during the Summer where the Hammond Fire Department and state police were investigating an incident on I-80/94 eastbound. The speeding white Dodge Charger was traveling about 100 miles per hour when the vehicle slammed into the fire engine and a state police vehicle, striking the trooper. The trooper was pinned to a Jersey barrier by a Subaru that was also struck by the Charger. He was transported to the hospital for evaluation and treatment of his injuries and released. A car accident attorney can help with insurance claims, or legal action after an accident causes harm and injury.

Insurance.

Indiana is a “fault,” state with regard to auto accidents, and requires drivers to carry a minimum amount of property damage and liability auto insurance. Accident victims have the right to pursue a personal injury, or property damage claim against an at-fault driver. This is referred to as filing a “third-party” claim. The State of Indiana follows the modified comparative negligence rule, where an individual recovers damages if they are 50% or less at fault for an accident. If that percentage is above 50% compared to other parties involved in the accident, an accident victim will not be able to recover anything from other parties. A car accident lawyer in Indiana can help identify possible defendants when a person is involved in an accident that results in property damage, injury or death.

Proving negligence.

When accidental injury, property damage and/or loss of life occurs, an accident victim will need to hire an experienced car accident attorney, who can build a case based on the facts of the accident, including the criminal reckless driving charges which will more than likely result in fault being that of the speeding driver.  In a personal injury lawsuit, damages can be recovered under Indiana Code sections 34-51-2-5 and 34-51-2-6 against an at-fault party, but they will be reduced by each driver’s share of the liability.

Hire an attorney.

The Law Office of Marshall P. Whalley can assess the pertinent data surrounding the accident and provide legal advice to pursue a claim against a reckless speeding driver.  Criminal activity will have some bearing on the civil lawsuit for damages based on state insurance requirements for each vehicle and percentages of fault assigned to drivers.
