Iowa driver loses control around a curve while passing another vehicle
Iowa City, IA – There are times when a simple action like trying to pass another vehicle on the road can have serious consequences. A minor mistake by a driver can sometimes result in large amounts of property damage and critical injuries.
KWWL reported on a two vehicle crash in Dubuque, Iowa that resulted in one person being seriously injured [1].
Two drivers lose control during an attempted pass
A report from the local government stated that the incident happened at approximately 11:30 pm on a Thursday night in the area of the 1000 block of Lake Eleanor Road. Two vehicles were both traveling eastbound on Lake Eleanor when one of them attempted to pass the other vehicle. Around this time, one of the vehicles did not successfully navigate a curve in the road and went into a field on the roadside. The other vehicle went eastbound slightly further, then hit a ditch and flipped over. The driver of the passing vehicle was identified as a 51 year old male, and he needed to be taken to Mercy One for treatment for serious injuries. He was eventually transported to University of Iowa Hospitals and Clinics for additional medical care. Another 34 year old male who was driving the other vehicle was examined by first responders at the scene. He refused treatment and did not appear to be seriously hurt.
Police did not release the names of the drivers and they are still in the process of conducting a full investigation of the collision.
Who is legally responsible for this crash?
After the accident it is likely that both drivers will report the situation to their insurance provider. This is always a good idea, as it is required under the terms of the auto insurance policy, and it can start the process for the people who may have experienced property damage or injuries to get payment for their losses. The insurance companies and their attorneys will examine any reports, evidence, or other pieces of information related to the car crash. Things like traffic violations, reckless driving, speeding, or drunk driving are often used as evidence of fault and negligence in motor vehicle crash cases.
