Tennessee driver drifts off of the side of the road and hits a pole

A fatal accident in Blount County, Tennessee caused the death of one young driver.

Driver dies after his car fell off of the side of the road

Deputies with the Blount County Sheriff responded to the area of 3100 Morganton Road at around 3 am. After checking the scene, the officers believe that the victim was going southbound on Morganton Road in the moments before the crash. They think that the man’s car suddenly went off of the right side of the road and drove through a ditch for several yards before turning back onto the road surface. They believe that he over-corrected with the turn and went off of the road a second time. Within seconds, he went off of the right side of the road again, then hit a utility pole on the driver’s side of the vehicle.

The 27 year old male victim was wearing his seatbelt, but he was pronounced dead at the scene by police. He was from the town of Maryville, Tennessee. The local sheriff assigned a Traffic Safety Unit to a full investigation of the scene and cause of the crash.

The Blount County Sheriff made a statement saying that their thoughts and prayers are with the families of the victim, as they had responded to two fatal car accidents within a week’s time.

Is the driver at fault in a single vehicle accident?

There are a number of factors that go into determining the legal cause and who is at fault in any motor vehicle collision. Just because only one driver or victim remains at the scene does not necessarily mean that this person is responsible. There can be scenarios where road construction, dangerous conditions, hit and run drivers, and other factors are involved. Sometimes, this may not be discovered until law enforcement has had the time to conduct a full accident investigation.

How will fault be determined for the purposes of insurance and lawsuits?

When someone gets in an accident, they will be required to contact the local police and their insurance company. It is a crime to leave the scene without at least making contact with the other driver. After this initial process, the police will begin their own accident investigation and form an opinion regarding what exactly happened. This document can be used both during the insurance claim process and at trial. The insurance company usually has their own internal process to handle how payments will be made to the drivers involved and deal with the opposing insurance provider. During a lawsuit, the jury is given the authority to make the final determination regarding who wins the case.
