Two pedestrians were injured after they were hit by a vehicle in Roswell on Tuesday afternoon, authorities said. The incident happened a little before 6:30 p.m. at the intersection of Woodstock Road and Westwind Boulevard, Roswell police said. It shut down all but one eastbound lane of Woodstock Road, and the road did not fully reopen until 9 p.m.
United States pedestrian fatalities are at their highest level since 1988. Recent data shows that 6,590 pedestrians were killed on U.S. roads in 2019, a 5% increase from 2018 and the continuation of a trend starting in 2009. The combination of light truck use, bad driving behaviors and unsafe road crossings are partially to blame for this trend. Smartphones and increased levels of technological distraction, an all too familiar distraction of everyday life, were recognized culprits both behind the wheel and on U.S. walkways.
Georgia is a Comparative Fault State which enables accident victims to seek damages up to 50% if they were partially responsible, but they will not receive any damages if they are 50%, or more responsible for the accident. Legal action must support a claim of negligence where the victim was owed a duty of care, there was a breach in that duty, and the breach caused the injuries or loss.
Damages and timeline.
Victims who have suffered loss from car accidents may have questions about how Georgia laws will affect property damage and personal injury claims when someone else was at fault. Under Georgia law, victims have the right to pursue compensation from insurance, whether they were a pedestrian, a cyclist, or riding in a vehicle when an accident occurred. A legal action seeking monetary compensation may ensue when a driver causes injury, or death to a pedestrian, often with the assistance of legal counsel. In Georgia, accident victims have two years from the date of an accident to file a legal claim against a negligent individual.
Compensation for any loss sustained as a result of a car accident, due to partial, or full negligence of another person, is in a victim’s reach to assist in the payment of any significant medical expenses, loss of wages, funeral expenses, and wrongful death claims caused by car accidents. Accident damages may include economic and non-economic losses, and punitive damages meant to punish the responsible party.
